Georgia Administrative License Suspension

With all the risks a drunk driver can impose on others, it’s no surprise that the penalties for driving under the influence (DUI) often include a license suspension. After all, as the old saying goes, “driving is a privilege, not a right”—and just like any other privilege, it can be revoked if it is not used properly. There’s certainly lot of truth to that statement when it comes to Lawrenceville drivers, as being arrested for DUI automatically leads to a Georgia administrative license suspension.

Anytime an officer makes a DUI arrest, he or she is required to notify the Department of Motor Vehicles (DMV) of the driver’s offense. Once the DMV receives this notification, an administrative license suspension will be issued immediately. You have just ten days to appeal this suspension; otherwise, your driving privileges will be revoked for 120 days or more—even if you are not convicted of your criminal DUI charges.

To appeal your license suspension, you must complete a 1205 form (the officer who arrested you most likely gave this document to you) and submit it to the DMV within ten business days after your arrest. After they receive your paperwork, the DMV will then schedule an administrative hearing to determine whether your license suspension should remain in effect or not.

Although you are not required to attend this hearing, it is best to have an experienced DUI defense attorney represent you at the proceeding. Your attorney will challenge the suspension to help you avoid losing your driving privileges. If the prosecution does not have an attorney present for this hearing—a situation that is seen in 90% of Georgia DUI cases—the state will be unable to oppose your request and your license suspension will most likely be lifted.

If all goes well during your administrative hearing, you may not only be able to keep your driving privileges, but your results can also be used to fight your criminal DUI charges in court. In many cases, the officer’s testimony, or lack thereof, may be used to challenge your arrest and help avoid the penalties of a DUI conviction, including fines and jail time.
