Georgia DUI First Offense

With so many celebrities escaping punishment for driving under the influence of alcohol (DUI), it’s easy to see why you might think being charged with DUI is no big deal. Well, think again—if you are arrested for drinking and driving in Lawrenceville, you face some of the most severe DUI penalties in the nation. What’s more, because these penalties are set by law, even a conviction for a Georgia DUI first offense can include mandatory fines, license suspension, community service, and jail time.

Under Georgia law, a first-time DUI offender is defined as a person who has not been convicted of DUI in the state within the last five years.  Repeat offenders (drivers who have a previous DUI conviction on their record), on the other hand, are subject to harsher penalties.

Of course, you won’t receive a light sentence simply because you have never been convicted of driving under the influence in the past. The minimum penalties for a first DUI offense in Georgia include fines ranging from $300 to $1,000, up to 40 hours of community service, a one-year license suspension, and a minimum 24-hour jail sentence.

Along with your previous criminal history, the exact punishment you receive will depend primarily on the circumstances of your case. For example, if you were involved in an auto accident or transporting a minor at the time of your arrest, you can expect far more than the minimum sentence. The same holds true if you had a blood alcohol content (BAC) above the legal limit of 0.08%, or were under the age of 21 when you were arrested—in fact, you may even be charged separately for these offenses.

As you can see, a Georgia DUI arrest should not be taken lightly. With such severe penalties, even a first-time offense can be life-altering. Fortunately, an experienced DUI defense attorney may be able to help reduce or eliminate your DUI charges and help you avoid a drunk driving conviction.
