Georgia DUI Misdemeanor

If you have been charged with driving under the influence (DUI) in Lawrenceville, chances are you will be charged with a Georgia DUI misdemeanor offense if your case did not result in a serious auto accident. However, regardless of how your crime is classified, you will face severe criminal penalties if you are convicted of drunk driving.

For a DUI charge to be classified as a misdemeanor, you must have no more than three prior DUI convictions on your record—otherwise, it will be considered a felony offense. But even if it is your first offense, your sentence could include probation, fines, and jail time. In addition, your driver’s license may be suspended for up to a year if you are found guilty of driving under the influence of alcohol.

Although drivers 21 and older may be granted limited driving privileges for work, school, and other activities approved by the court, drivers under 21 will lose their license for no less than six months if they are convicted of DUI—and regardless of your age, the judge may impose additional penalties such as DUI school and probation.

Of course, the sentencing guidelines mentioned above are just for first-time DUI offenders. You can expect to be punished more severely if you have been convicted of driving under the influence within the past five years.

A misdemeanor offense will also remain on your criminal background indefinitely. Because it can be quite difficult to have a DUI conviction removed from your Georgia criminal record, you can expect to encounter problems in the future—such as obtaining employment and housing. You may even be ineligible for certain educational opportunities as a result of your conviction.

If you have been charged with misdemeanor DUI in Georgia, it is important to discuss your case with an experienced defense attorney immediately after your arrest. In many cases, your attorney may be able to challenge certain evidence and prevent it from being used against you in court—thereby improving your chances of getting your charges reduced or dismissed.
